Longwood Nursery

Terms of Service

Welcome to Longwood Nursery. These Terms of Service ("Terms") govern your use of our website and the purchase of our products.

By accessing our website or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use our services.

1. About Us

Longwood Nursery is an online gardening store offering plants, seeds, and related planting products.

Our goal is to make quality plants and seeds accessible to gardeners across the United States.

We currently serve customers within the United States only.

2. Use of Our Website

By using our website, you agree to the following:

You will use our website for lawful purposes only.
You will not misuse, damage, disrupt, or interfere with website operations.
You will not attempt unauthorized access to restricted website areas.
You will provide accurate information when placing orders.
You will not use our website for fraudulent or unlawful activities.

We reserve the right to refuse service, restrict access, or cancel transactions where reasonably necessary and permitted by applicable law.

3. Products & Orders

All products offered by Longwood Nursery are subject to availability.

We may limit product quantities or availability.
We may refuse or cancel orders when necessary, subject to applicable law.
Customers must provide complete and accurate billing and shipping information.
Product descriptions and prices may be updated periodically.
Certain plants and seeds may be subject to shipping restrictions.

Due to the natural characteristics of plants and seeds, products may vary in size, shape, color, and appearance.

Product photographs may display representative or mature specimens rather than the exact item supplied.

4. Nature of Our Products

Plants and seeds are natural living products whose growth and development depend on environmental conditions.

We do not guarantee seed germination, plant growth, flowering, fruit production, or long-term plant survival.

Growing results depend on factors beyond our control, including:

Climate and temperature
Soil quality and drainage
Sunlight and humidity
Watering practices
Planting techniques
Pest and disease exposure
Customer handling and ongoing care

Customers are encouraged to review product information and follow recommended planting and care instructions.

These growing limitations do not remove any legal rights relating to defective, damaged, or incorrectly described products.

5. Shipping

Longwood Nursery offers free standard shipping on eligible orders within the United States.

We currently do not offer international shipping.

Processing and delivery times may vary depending on product type, seasonal demand, preparation requirements, and carrier conditions.

Orders may be fulfilled from different locations and may arrive in separate packages.

For complete information, please review our Shipping Policy.

6. Returns & Refunds

All sales are generally final, except where otherwise required by applicable law or expressly provided in our Return & Refund Policy.

We generally do not accept returns or provide refunds for the following reasons:

Failure of seeds to germinate due to growing conditions
Failure of plants to grow or survive after delivery due to improper care
Customer change of mind
Customer ordering mistakes
Normal plant variations or seasonal appearance
Minor shipping stress or cosmetic changes

If an item arrives severely damaged, appears dead on arrival, or does not match the order, please contact our support team.

Under our voluntary claims policy, delivery-related issues should be reported by email within 48 hours of confirmed delivery.

Refunds, replacements, and other resolutions are subject to review, our published policies, and applicable consumer rights.

Please refer to our Return & Refund Policy for complete details.

7. Limitation of Liability

To the extent permitted by applicable law, Longwood Nursery is not responsible for losses resulting solely from:

Improper planting or plant care after delivery
Unsuitable climate or growing conditions
Natural variations in plant growth or development
Factors outside our reasonable control

To the fullest extent permitted by applicable law, we disclaim liability for indirect, incidental, or consequential damages.

Where legally permitted, our total liability for a product-related claim will not exceed the amount paid for the affected product.

Important: Nothing in these Terms excludes or limits liability, consumer protections, or remedies that cannot legally be excluded or limited.

8. Intellectual Property

The Longwood Nursery name, logo, branding, and original website content are protected by applicable intellectual property laws.

Unless otherwise indicated, website materials owned or licensed by Longwood Nursery may not be copied, reproduced, distributed, or commercially used without authorization.
